Terms & Conditions

By completing and returning this information we agree to the below terms & conditions.
1. Deposit and Payment. The client shall pay the full session fee at the time of booking, after receiving the invoice. If the client cancels this agreement within 24 hours, Coastal Love Collective will retain the session fee. 

2. Photographic Material. All photographic materials including all original images, video footage and proofs shall be the exclusive property of Coastal Love Collective. Coastal Love Collective may make proofs available for the client on a USB, portable hard-drive, website, Dropbox or any other recordable device.

3. Copyright and Reproduction. Coastal Love Collective shall obtain the copyright of all images created and shall have the exclusive right to make reproductions. Coastal Love Collective shall make reproductions for the client or for Coastal Love Collective's portfolio, self-promotions, for Coastal Love Collective's website, blog, facebook, Instagram, Social Media, entry into photographic contest or art exhibitions, editorial use, for other wedding providers, for display within or on the outside of the studio or for any other advertisement or suitable purpose.

4. Client’s Usage. The client is obtaining prints for private business usage only, and shall not sell prints or authorise reproduction thereof by parties other than Coastal Love Collective. Coastal Love Collective authorises the client to reproduce the print for private business usage only, including usage on social media, website, print media, advertising and in house display. 

5. Failure to Perform. If Coastal Love Collective cannot perform this agreement due to casualty, sickness, act of God or other cause beyond control.  Coastal Love Collective will return all monies paid to them by the client in relation to this booking but shall have no further liability with respect to the agreement.  Coastal Love Collective will always do it's best to insure all work is carried out in a professional manner.

This limitation on liability shall also apply in the event that the photographic or video materials are damaged, lost through camera malfunction or otherwise lost or damaged without fault on the part of Coastal Love Collective. In the event the photographer/videographer fails to perform for any reason, Coastal Love Collective shall not be liable for any amount in excess of the retail value of the clients order. Coastal Love Collective may substitute another competent professional photographer/videographer to take the photographs/video in the event of illness or of scheduling conflicts.

6. Inherent Qualities. Client is aware that colour dyes in photography may fade or dissolve over time due to the inherent qualities of dyes, and client releases Coastal Love Collective from any liability for any claims whatsoever based upon fading or discolouration due to such inherent qualities. The client also is aware that USB’s may fail and damage over time, and the client releases Coastal Love Collective from any liability for any claims whatsoever based upon unforeseen damages to USB’s.

7. Clients. Clients and client’s family and friends are responsible for their own actions on the photographer’s & Coastal Love Collectives premises and on location.

8. The charges in this agreement are based on Coastal Love Collective's standard price list. This price list is adjusted periodically and future orders shall be charged at current pricing.

9. Albums. If the client/s fails to provide Coastal Love Collective with their album selection or fails to approve their album design within 12 months of their session date the client will be charged current album pricing and a design fee.

10. Digital Negatives. The client/s high resolution USB's or high resolution download is their digital negatives.  Coastal Love Collective cannot guarantee another copy.  Client/s shall secure their images by making multiple copies and storing them in different locations.  The client/s shall protect their digital negatives.  Coastal Love Collective cannot guarantee another copy of the clients digital negatives.  The client shall report any problems with their digital download or high resolution USB within 7 days of receiving them. The client shall have 7 days to report any issue or complaint, and only one set of changes per cinematic highlights trailer is allowed per session. 
11. Photographic Schedule. The photographic schedule supplied by Coastal Love Collective is a guide only and may change on the session day due to events out of the photographers control.  The photographer/videographer will endeavour to photograph/video the session as the event unfolds.

12. If client's selection locations that require fees/donations the client shall pay the fees/donations. e.g. The Famous One Tree Hill Paddock Maleny requires a $50 donation prior to using the paddock.  In some cases the client may need to contact the owner to gain permission to access a private location.

13. Miscellany. This agreement incorporates the entire understanding of the parties. The laws of the state of Queensland shall govern this agreement.

14. If you wish for your images not to be published on the internet / blog / Facebook / Instagram / Wedding Blogs please email Coastal Love Collective to alert us once you have completed this booking form.  Also, please make sure you make a note of this in the additional details section on this form.
